Recognizing the central role that public procurement plays in public service delivery, financial management, and sustainable development, this MAPS MAIN assessment resulted in recommendations targeting the clarification and strengthening of the legal and regulatory framework, the establishment of a comprehensive sustainable public procurement strategy, the enhancement of institutional coordination and procurement capacity-building, the implementation of a structured performance monitoring system, the promotion of competitive procurement practices, the facilitation of MSME participation, the improvement of procurement transparency through open data initiatives, the strengthening of anti-corruption mechanisms, and the reform of complaints and appeal procedures to ensure fair and efficient resolution of disputes.

Background

Why was a MAPS assessment initiated?
The MAPS assessment was conducted as part of Côte d'Ivoire's ongoing efforts to align its public procurement system with international standards. It falls within the framework of the National Development Plan (PND 2021-2025) and aims to strengthen governance to support private sector-led development.

Who initiated the assessment?
The Government of Côte d'Ivoire requested the evaluation, with technical support from the African Development Bank (AfDB). The Ministry of Budget and State Portfolio mandated the National Authority for Public Procurement Regulation (ANRMP) to oversee the assessment.

Brief description of the country procurement system
The public procurement system in Côte d'Ivoire has undergone several reforms to improve transparency and efficiency. It is regulated by the Public Procurement Code and follows the guidelines of the West African Economic and Monetary Union (UEMOA). The system is decentralized, with procurement responsibilities distributed among various contracting authorities.

Is there anything else about the country that merits mention?
The country has implemented significant reforms, including a 2019 revision of the Public Procurement Code to enhance institutional frameworks and integrate digital procurement tools. Additionally, external factors like the COVID-19 pandemic and global economic challenges have influenced procurement policies.

Were there any disruptions?
No major disruptions were reported, and the assessment was conducted with the support of the ANRMP and international partners. However, economic challenges related to the pandemic and geopolitical tensions were noted as influencing the procurement landscape.

Main results and impact

Issue: The public procurement legal framework lacks clarity on specific rules and procedures, leading to inconsistencies in implementation.
- Recommendations: Improve the legal framework by streamlining rules, ensuring consistency, and aligning national regulations with international best practices.
Issue: The regulatory framework does not provide clear guidance on sustainable public procurement (SPP).
- Recommendations: Develop a National Sustainable Public Procurement Strategy with detailed policies and guidelines, including life-cycle costing and sustainable award criteria.

Issue: The procurement institutional setup lacks effective coordination among key regulatory bodies.
- Recommendations: Establish clear roles and responsibilities for procurement institutions and enhance collaboration to improve efficiency.
Issue: Capacity-building programs for procurement officials are insufficient and not systematically implemented.
- Recommendations: Strengthen training programs by establishing structured capacity-building initiatives, including certification and continuous education.
Issue: The absence of a formal procurement performance monitoring system limits oversight and accountability.
- Recommendations: Implement a performance measurement system with clear indicators to monitor and evaluate procurement efficiency.

Issue: The use of direct awards is not always well justified, reducing competition and transparency.
- Recommendations: Strengthen the justification process for direct awards and promote competitive procurement methods.
Issue: Procurement planning and market research are insufficient, leading to inefficiencies in procurement processes.
- Recommendations: Enhance market analysis and procurement planning to improve value for money and supplier participation.
Issue: Limited participation of Micro, Small, and Medium Enterprises (MSMEs) in public procurement.
- Recommendations: Implement targeted policies to support MSMEs, including capacity-building, financial assistance, and simplified bidding processes.

Issue: Limited access to procurement information and weak transparency mechanisms.
- Recommendations: Improve public access to procurement data through an open procurement portal and proactive disclosure policies.
Issue: Weak enforcement of anti-corruption measures in procurement.
- Recommendations: Strengthen integrity mechanisms, including better whistleblower protections and stricter enforcement of conflict-of-interest rules.
Issue: Complaints and appeal mechanisms lack efficiency, discouraging suppliers from challenging procurement decisions.
- Recommendations: Reform the complaint system to ensure a fair and timely resolution of procurement disputes.
